Ninth Circuit Refuses Stay of Executive Order Prohibiting Travel

In order to prevail on a stay, the moving party (the federal government) needs to show that there is a likelihood they will win and irreparable harm will occur if the order is not stayed. The Ninth Circuit issued an order today declining to stay Judge Robart’s temporary restraining order against the travel ban. It determined that the federal government did not show a likelihood of prevailing or irreparable harm.
