Legal Malpractice and Negligence in Drafting a Contract: Paradise Orchards

Paradise Orchards v. Fearing is Washington appellate court case addressing issues of legal malpractice. The case involved a dispute between the owners of an orchard and their attorney, who had prepared a contract for the orchard. The orchard owners had wanted a contract with certain clauses in it and argued their attorney had not appropriately drafted those clauses. The company claimed that the attorney had committed legal malpractice by failing to appropriately draft the contract, and that they had suffered damages as a result.

Paradise Orchards helps define what a plaintiff in a Washington legal malpractice claim must prove about the cause of their injuries. The orchard owners, after losing a lawsuit against the buyers, compromised and settled their claims rather than appeal. They later claimed that their attorney’s negligence in drafting the contract had caused their harm.

The court held that the orchard owners had not proved the alleged legal malpractice had caused their harm because they voluntarily gave up the right to appeal the decision.
